Strategi Pencegahan Kekerasan Seksual Melalui Penguatan Spiritualitas Qur'ani dan Maqamat Sufi

Abstract

Penelitian ini bertujuan menganalisis potensi, validitas, dan keterbatasan maqamat sufi sebagai strategi preventif kekerasan seksual, termasuk Kekerasan Berbasis Gender Online (KBGO), melalui integrasi dengan perspektif keadilan gender dan kerangka hukum Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS). Kebaruan penelitian ini terletak pada pengembangan maqamat sufi sebagai paradigma preventif yang tidak hanya bersifat spiritual-individual, tetapi juga etis-struktural dan kontekstual melalui integrasi tasawuf, kritik gender, dan sistem hukum modern dalam pencegahan kekerasan seksual. Metode penelitian menggunakan pendekatan kualitatif dengan desain normatif-kritis yang dipadukan dengan analisis sosio-legal dan hermeneutik filosofis model Hans-Georg Gadamer dan Paul Ricoeur. Data primer berupa tafsir sufistik Ibn ‘Ajibah dalam al-Bahr al-Madid, sedangkan data sekunder mencakup literatur tasawuf, kajian gender, dokumen hukum, serta studi kekerasan seksual kontemporer. Hasil penelitian menunjukkan bahwa maqam wara’, iffah, muraqabah, dan ihsan memiliki relevansi operasional dalam membentuk self-regulation, etika relasi, dan kesadaran moral yang berfungsi mencegah kekerasan seksual pada level personal, digital, dan institusional. Konsep muraqabah digital dan iffah digital memperlihatkan perluasan etika spiritual dalam merespons KBGO. Namun, efektivitas pendekatan spiritual bergantung pada integrasinya dengan kesadaran struktural, perspektif gender, dan kebijakan implementatif dalam penegakan hukum.
